Трансформація принципу свободи відкритого моря в умовах декарбонізації судноплавства

Анотація

Принцип свободи відкритого моря, кодифікований у статтях 87 та 90 Конвенції ООН з морського права 1982 року, є фундаментальною засадою міжнародного морського правопорядку. Глобальна кліматична криза зумовлює трансформацію правового регулювання судноплавства, яке відповідає за приблизно 2,89 % глобальних викидів CO₂. У статті здійснено комплексний доктринальний аналіз впливу декарбонізаційних механізмів IMO (EEDI, EEXI, CII) та EU ETS на зміст і обсяг принципу свободи відкритого моря. Встановлено, що технічні стандарти IMO є легітимним розвитком правового режиму відкритого моря, тоді як CII запроваджує якісно новий тип непрямого обмеження свободи судноплавства. Виявлено, що включення судноплавства до EU ETS створює прецедент екстратериторіального застосування регіонального законодавства. Обґрунтовано системну колізію між парадигмами виключного мультилатералізму та регуляторної конкуренції. Запропоновано авторську теоретичну модель «екологічно обумовленої свободи судноплавства», яка розглядає екологічні зобов’язання як іманентний елемент змісту свободи відкритого моря.
