Анотація

У статті розглянуто деякі аспекти впливу розвитку та імплементації цифрових засобів на зміст окремих стандартів права на доступ до правосуддя. Наголошено на необхідності широкого підходу до розуміння права на доступ до правосуддя, що охоплює перелік відповідних стандартів його забезпечення. Через аналіз досвіду окремих країн у впровадженні цифрових засобів розкрито зміст впливу на механізми юридичного захисту та правової обізнаності, що є стандартами права на доступ до правосуддя. Виокремлено важливість дистанційного провадження в механізмах судових та альтернативних засобів вирішення спорів, а також спрощеного доступу до механізмів вирішення певної категорії спорів. Зроблено висновок, що відповідні цифрові платформи можуть сприяти розвантаженню судів, що полегшить вирішення складних спорів і позитивно вплине на загальне забезпечення прав і свобод. Наголошено на необхідності формування відповідних стандартів і принципів з урахуванням технологічних особливостей цифрових платформ та порядку онлайн-захисту відповідних прав.
