Перспективи розвитку електронного судочинства в Україні

Анотація

У статті розглянуто перспективи розвитку електронного судочинства в Україні, орієнтуючись на стратегічний курс України на набуття повноправного членства в Європейському Союзі та пов’язані з цим євроінтеграційні зобов’язання. Наголошено на важливості врахування під час впровадження електронного судочинства закріплених у Законі України «Про судоустрій і статус суддів» завдань (верховенство права, європейські стандарти, забезпечення кожному права на справедливий суд та поваги до інших прав і свобод), а також закріплених у ст. 129 Конституції України основних засад судочинства. Проаналізовано особливості роботи модулів Єдиної судової інформаційно-телекомунікаційної системи (ЄСІТС). Виявлено потребу у вдосконаленні окремих аспектів для забезпечення орієнтованого на користувачів функціонування системи, зокрема доповнення додатковими інструментами та інформацією електронного кабінету, збільшення різноманітності шаблонів процесуальних документів, вдосконалення інструкцій для користувачів електронного суду. Звернено увагу на потребу у вирішенні поточних проблем функціонування електронного судочинства, як-от технічні збої та загрози кібербезпеці, зазначено про потребу в належному захисті даних в електронному судочинстві, в підвищенні цифрової грамотності та забезпечення технічним обладнанням, у вдосконаленні нормативно-правового регулювання та ін. Здійснено огляд перспектив використання штучного інтелекту для забезпечення стабільної та ефективної роботи електронного судочинства. Зроблено висновок про те, що забезпечення функціонування інструментів електронного судочинства в сучасних умовах стрімкої цифровізації слід розглядати як елемент доступу до правосуддя, що, своєю чергою, є невіддільним елементом верховенства права.
